TABASCO® Cook & Ladder® Competition
2008-2009 OFFICIAL RULES
Contest: NO PURCHASE NECESSARY. VOID IN PUERTO RICO AND WHERE PROHIBITED OR RESTRICTED BY LAW. The TABASCO® Cook & Ladder® Competition (the “Contest”)
begins at 12:01 AM (EST) on May 12, 2008, and ends at 11:59 PM (EST) on November 7, 2008 (the “Contest Period”). Odds of winning depend on
the number of eligible entries received. The Contest is sponsored by
McIlhenny Company, manufacturer of TABASCO® brand products (“McIlhenny” or “Sponsor”).
Eligibility: All Contest entrants must be (i) legal
U.S. residents residing in one of the fifty (50) United States at the time of
entry; (ii) full-time or volunteer firefighters who are affiliated with a firehouse
in one of the fifty (50) United States at the time of entry; and (iii) 18 or
older as of May 12, 2008. Persons with professional culinary training
(i.e., those who are/were enrolled full-time at a professional culinary
institute such as Johnson & Wales, The French Culinary Institute or Culinary
Institute of America, for a minimum of one semester) are not eligible. McIlhenny,
Hunter Public Relations, competitors of McIlhenny, and its and their subsidiaries,
affiliates, agents, judges, participating retailers, advertising and promotion
agencies, and fulfillment companies, and the officers, directors, shareholders
and employees and the immediate family members of each of the foregoing (parents,
children, siblings, spouse) and members of their same household (whether related
or not) are not eligible to enter the Contest.
By submitting an entry, entrants agree that, if they are selected as a finalist,
they will be available to travel to New York, N.Y. between January 15, 2009,
and February 28, 2009 (travel expenses paid or reimbursed by Sponsor as detailed
more fully below), arriving two (2) days prior to the cook-off event and remaining
one (1) day after such event. If an entrant is selected as a finalist
and cannot travel during this time, he or she will be disqualified and an alternate
finalist will be selected. If selected as a finalist, all entrants must
be willing to conduct media interviews and make public appearances on behalf
of Sponsor prior to, during and after the Contest. Sponsor will cover
travel and incidental expenses for finalists’ media interviews and appearances. Entry
into this Contest constitutes permission to use each entrant’s and finalist’s
name, image/likeness, voice and biographical material as well as the contents
of his or her entry in advertising and publicity and for other promotional purposes
in all media now known or hereafter devised (including, without limitation,
in event photos posted on the TABASCO® Web site at www.TABASCO.com (the “Site”)
and press materials) without notice, compensation or other consideration by
Sponsor (except where prohibited by law).
How to Obtain an Entry Form: Official entry forms are
available on the Site. Alternatively, an entry form can be obtained by
sending a stamped, self-addressed #10 envelope to: TABASCO® Cook & Ladder® Competition, c/o Hunter Public Relations, 41 Madison Avenue, 5th Floor,
New York, NY 10010; or e-mailing a request to cookandladder@hunterpr.com. The
official entry form must be included with all submissions during the Contest
Period.
To Submit an Entry: Contest entrants must create an
original recipe for an appetizer, soup, salad, main dish, side dish or dessert
using at least one (1) of the six (6) TABASCO® brand Pepper Sauces: Original TABASCO® Sauce, TABASCO® Green Sauce, TABASCO® Garlic Sauce, TABASCO® Chipotle Sauce, TABASCO® Habanero Sauce, or TABASCO® SWEET & Spicy Sauce. The recipe
must be typed or printed on 8½ by 11 paper in standard recipe format,
which means it must be in exact standard U.S. measurements, and the ingredients
and measurements must be listed in order of use. Entries must include
complete step-by-step preparation and cooking instructions, cooking times and
temperatures, required utensils and number served (if applicable). All
entries must also include a color photograph of the finished recipe and be accompanied
by a fully completed official entry form. Any entries missing one or more
of the abovementioned elements may be disqualified. For more information

The only way to enter the Contest is by mail. Submission must be sent

Entries must be postmarked by October 31, 2008 and received by November 7,
2008. Entries submitted using any method other than U.S. regular mail
will not be considered.
Entry Details: An entrant’s submission must be
entirely his or her original composition, executed solely by that entrant and
must not have been published previously or won any other award, or be subject
to any restriction or limitation on the right to submit any portion of the entry
into the Contest or to use any portion of the entry. Entry cannot defame
or invade the publicity or privacy rights of any person, living or deceased,
or otherwise infringe upon any person’s personal or proprietary rights. No
mechanically reproduced, illegible, incoherent, late, mutilated or incomplete
entries will be accepted. Sponsor is not responsible for typographical
errors, omitted ingredients, or any other errors submitted by entrants. Neither
Sponsor nor Hunter Public Relations will be responsible for lost, late, damaged,
destroyed, delayed, misdirected, mutilated or postage due entries, or for defects
or malfunctions of electronic equipment, computer hardware or software, delays
in operation, problems requesting (via mail or e-mail) or downloading entry
form from the Site or for other technical problems related to the Internet.
An entrant may enter as many times as he or she wishes during the Contest
Period, but there is a limit of one (1) mailed entry per envelope and each entry
must be substantially different. Entries not complying in all respects
with the Official Rules are subject to disqualification. In consideration
of participating in the Contest, each entrant unconditionally and irrevocably
assigns and transfers to Sponsor all right, title and interest in the contents
of his or her entry, including, without limitation, the copyright therein, and
upon Sponsor's request, will execute any documents necessary to effectuate such
assignment and transfer. By entering, entrants agree that they have no
right to bring, and covenant not to bring, any claim, action, or proceeding
of any kind or nature whatsoever against Sponsor, any of its affiliates or subsidiaries,
Hunter Public Relations, or its or their officers, directors, agents, employees,
or shareholders in connection with this Contest. Entrants shall not receive
any compensation or credit for use of entries, other than that disclosed in
these Official Rules.
Judging:
Ten (10) finalists will be selected from all eligible entries by a panel of judges
using the following objective criteria: originality and creativity (25%), taste
(25%), use of TABASCO® brand Pepper Sauce
(25%), and recipe clarity and
construction (e.g., legibility, completeness) (25%). Entries will
be judged by a panel of judges, including McIlhennny Company representatives
and independent chefs. In the event of a tie, the entries involved will
be re-judged by an additional independent judge who will serve as a tiebreaker
and who will evaluate entries according to the criteria listed above. The
ten (10) finalists will be notified by mail on or about December 1, 2008 and
must be able to participate in the cook-off event to be scheduled between January
15, 2009, and February 29, 2009. If a finalist or finalists cannot be
reached after a reasonable effort has been made, or if such finalist or finalists
are found to be ineligible, an alternate finalist may be selected. Photographs
of finalists and recipes may be featured on the Site and in other promotional
materials.
Grand Prize Winner: The
cook-off will be judged by a panel of judges, including firefighters, chefs,
journalists and McIlhenny Company representatives. The Grand Prize winner
will be determined based on the following criteria: originality and creativity
(25%), taste (25%), use of TABASCO® brand Pepper Sauce
(20%),
recipe clarity and construction (e.g., legibility, completeness) (15%),
and presentation (15%). In the event of a tie, the finalist with the highest
combined score in originality/creativity and taste will be selected as the Grand
Prize winner. The Grand Prize winner will be announced at the cook-off event
and may be posted on the Site.
Decisions of judges are final and binding on all matters related to this Contest
and are not open to appeal.
Prizes: Ten (10) finalists: a trip to New York, N.Y.,
including round-trip coach class airfare for one (1) to New York City, from
and to the major commercial airport nearest the finalist’s home on the
Sponsor’s carrier of choice (stopover trips are not allowed) and ground
transportation to and from the finalist's home and the airport; single occupancy
hotel accommodations during the cook-off event; transportation to and from the
airport and hotel; and incidentals (not to exceed $75 per day), which shall
be reimbursed by Sponsor within a reasonable period of time after receiving
appropriate receipts documenting the amounts spent. All receipts must
be received by Hunter Public Relations within twenty-one (21) days following
the date of the Contest finals to qualify for reimbursement. ARV: $3,000.
One (1) Grand Prize: $10,000
($5,000 for firefighter, $5,000 for his/her firehouse).
One (1) First Runner-Up
Prize: $5,000 ($2,500 for firefighter, $2,500 for his/her firehouse).
One (1) Second Runner-Up
Prize: $2,000 ($1,000 for firefighter, $1,000 for his/her firehouse).
Prize Restrictions: Sponsor reserves the right, in
its sole discretion, to substitute a prize or prizes of equal or greater value
for any and all prizes. Prizes are not transferable and no other substitutions
or cash equivalents allowed. All prize money will be split evenly between
the winning firefighters and their firehouses. Sponsor shall have the
right to use, alter, assign, reproduce, display, publish, distribute, or dispose
of all entries in Sponsor's sole discretion, and entrants shall have no right
of approval or consultation with respect thereto. As a condition of claiming
a prize or award, each finalist may be required to sign and return an Affidavit
of Eligibility and Publicity/Liability release within ten (10) days of the date
of the finalist notification. Noncompliance within this time period will
result in disqualification and selection of an alternate finalist. Correspondence
will not be acknowledged. All prizes will be awarded as long as there
are a sufficient number of eligible entries. Winners are solely responsible
for reporting and paying any and all applicable federal, state, and local taxes
and any additional fees associated with prizes.
General Conditions: This Contest is governed by the
laws of the State of New York. By participating in the Contest, entrants
and finalists also agree: (i) to be bound by and abide by these Official Rules
and by all decisions of Sponsor, whose decisions are final and not subject to
appeal on all matters related to the Contest; (ii) on behalf of themselves,
their executors, heirs and assigns, to release and hold Sponsor, Hunter Public
Relations and its and their respective directors, officers, employees, subsidiaries,
affiliates, agents, employees, suppliers, divisions, agencies, licensors and
advertising, promotional, or judging agencies, and any all prize suppliers (“Released
Parties”), harmless from any and all liability whatsoever for all injuries,
losses or damages of any kind to persons or property arising out of participation
in the Contest and/or the acceptance, possession or use/misuse of any prize,
and claims based on publicity rights, defamation, or invasion of privacy, whether
suffered by entrant or a third party, while preparing for, participating in
or traveling to and/or from any prize-related activity; (iii) to be contacted
by Sponsor by mail, e-mail and/or phone, as applicable; and (iv) that neither
Sponsor, nor any of the foregoing entities have made or are responsible or liable
for any warranty, expressed or implied, relative to a prize, including, but
not limited to, its quality. Without limiting the foregoing, Sponsor reserves
the right, in its sole discretion, to suspend, modify or cancel the Contest
for any reason, and, in the event of a suspension, modification or cancellation,
neither Sponsor nor any of the parties contributing to the Contest will be required
to reschedule the Contest and/or compensate any entrant for lost time, wages,
fees, travel expenses or costs of any kind spent in preparation for the Contest.
All federal, state and local laws apply.
Failure to comply with the Official Rules will result in disqualification. An
entrant’s entry will be disqualified, at the sole discretion of McIlhenny,
if he or she attempts (a) to enter the Contest through any means other than
described in these Official Rules; or (b) to disrupt the Contest, circumvent
the terms and conditions of these Official Rules, or in any way tamper with
any component of the Contest.
Official Rules/List of Winners: For
the names of the Grand Prize winner and runners-up, available after, on or about
March 1, 2009, and/or a copy of the Official Rules, send a separate, stamped,
